On July 10, 2024 Supreme Court stated that Maintenance is not the matter of charity but a Fundamental Right, and Muslim women have the right to seek the Maintenance from their husband under the section 125 of the Erstwhile Code of Procedure (CrPC), and is applicable to all the married women no matter whatsoever religion they follow.
This important vedict came from the Bench of Justice BV Nagarathna and Justice Augustine George Masih dismissed a Muslim man’s petition named Abdul Samad try to deny the order of Telangana High Court as he was not ready to pay for the Maintenance of his wife after the divorce. Justice Nagarathna mentioned that; “We are hereby dismissing the criminal appeal with the major conclusion that
Section 125 would be applicable to all women and not just married women.”
The court also mentioned that this right is the fundamental right, beyond any religion boundaries and it is very important to maintain the principle of Gender Equality and Financial Security for all married women. The court also mentioned that some husbands have taken their housewives for granted, and they have forgotten that, their wifes are dependent on them emotionally and in other ways. The time has reached for Indian men to recognise the unconditional support, Crucial role and sacrifices made by housewives for the family.
